PLF filed an Amicus Brief in the Supreme Court!

On behalf of an impressive number of mining associations and municipalities, Pacific Legal Foundation (PLF) has filed a supporting brief in the U.S. Supreme Court on behalf of the mining community. You can find it right here:

Remember; at this stage, we are doing our best to convince the U.S. Supreme Court to review the BOHMKER case (Bohmker v. Oregon, 903 F.3d 1029 (9th Cir. 2018)).

Normally, The Supreme Court is only able to review about 5% of the cases that it receives. This is why it is so important that we must beat the drum as vigourously as we can to demonstrate that this case is very important to thousands of people, and has important implications that will affect America's future national interest.

The end result of this case if it is accepted by the Supreme Court will, once and for all, set limits, if any, upon how much authority the States have to impede or prohibit mining activity on America's federal lands.

We believe the long history of case law from the Supreme Court will support our side, especially with the existing makeup of the Court.

But that can only happen if we push hard right now to promote how important the case is to the national interest.

We have been fighting this battle in the courts for about 10 years. It has been a long and expensive journey. We have pretty much come down to the moment of truth. If we can get BOHMKER reviewed by the high court, and the high court rules in support of miners, we should be able to get the States out of our way and go back to work.
